Abstract

This article aims to analyse, with the growing advancement of science, possible legal effects arising from the use of human reproduction techniques assisted in the Institutes of Affiliation and succession, as well as highlight the need for legislation To discipline the use of these techniques. This thematic on the use of human reproduction techniques in Brazil enabled the elaboration of a specific problem involving the institutes of Affiliation and succession, that is, whether the use of assisted human reproduction techniques are easing Legal concepts already established in the Institutes of Affiliation and succession. In the search for an answer to the problem raised, it was a positive hypothesis to investigate the possible inserts of the use of the technique in already established concepts of the institutes, affiliation and succession. In this respect, after a brief synthesis on the science and dignity of the human being in the embryonic phase, the techniques of assisted Huma reproduction are addressed, and some legal effects arising from the use of human reproduction techniques assisted in Institutes of affiliation and succession that contemplates Brazilian legislation. In order to obtain the results sought in the research, the method of approach to be followed will be the empirical-dialectical, using the bibliographical and legislative research, based on the studies of PEDRO FEMENÍA LÓPEZ, "Status" civil legal del Embrión Human, Con special Consideración al designed "in vitro" and several Brazilian doctrines that address the thematic. As a conclusion, it is pointed to the need for Brazilian legislation to contemplate the human reproduction assisted with the preservation of the right to dignity, to the affiliation, to the succession of the conceived and the born of the use of the techniques.
